Events Privacy Policy

Intercontinental Exchange, Inc. and its affiliates, including ICE Mortgage Technology Holdings, Inc., and its affiliates (collectively, “ICE”, “we” or “us”) respects your concerns about privacy. This Events Privacy Policy (“Events Privacy Policy”) applies to information that may be used, directly or indirectly, to identify you (“Personal Information”) that we collect before, during, and after an ICE or ICEMT event such as a webinar, conference, or seminar (an “Event”). This Events Privacy Policy describes the types of Personal Information we obtain, how we use the Personal Information, and to whom we may disclose it. We also describe the rights you may have and how you can contact us about our privacy practices. To the extent that the Event registration process requires you to interact with any ICE website, app, or other Digital Service (as defined in the ICE Privacy Policy), the ICE Privacy Policy shall be incorporated by reference. To the extent that the Event registration process requires you to interact with any ICEMT website, app, or other service, the ICEMT Privacy Policy shall be incorporated by reference.

ICE is the data controller in respect of Personal Information that we collect through the Event registration process. Our contact details can be found below.

Collection of Personal Information

We collect, or have collected in the previous 12 months, Personal Information about you that you choose to provide to us. The Personal Information collected includes, but is not limited to:

Identifiers, such as your name, address, country of residence, phone number, email address, social media profiles, or other identification details;
Professional information, such as your job title, company, or location;
Financial information, including when making a purchase; and
Audio, electronic, visual, or similar information, such as photographs or voice recordings.
Inferences concerning the above categories: and
Your preferences, such as how often you wish to receive marketing or other communications.

Generally, the Personal Information that you provide to us will be apparent based on the context in which you provide it. For instance, when you fill out a form when signing up for the Event, you will generally provide your name, contact details and any other information requested by the form. Each form or survey may vary in terms of the information required and collected.

Please note that we may be required by law to collect and use certain Personal Information about you, including to enter into or fulfill a contractual obligation with you. Failure to provide this information may prevent or delay the fulfillment of our obligations in these circumstances.

Use of Your Personal Information

We primarily use your Personal Information to provide you with access to Events and to respond to your inquiries. We also may use your Personal Information as follows:

To communicate with you, including to respond to your comments or requests for information, to request feedback on our Events, to notify you about upcoming Events, and to provide you with information about the Event;
To administer your participation in the Event or to provide you with access to our products and services;
To provide materials associated with the Event, for example a pre-event registration pack or post-event certificate;
To operate, evaluate, and improve the Event or our business;
To develop new products and services;
To perform market research, such as through surveys;
To advertise and market our products and services;
To determine the effectiveness of our advertising and marketing;
To comply with legal and/or regulatory requirements and cooperate with regulators or law enforcement bodies;
To protect our rights, your rights, and the rights of others;
To analyze our products, services, and websites; and
To administer the Event and related aspects.

Information for European Attendees

Under UK and European privacy laws, we must have a legal basis to process Personal Information. In most cases, the legal bases for our processing, under UK and European privacy laws, will be one of the following:

To fulfill our contractual obligations to you;
To comply with our legal and/or regulatory obligations or protect our rights, your rights, and the rights of others, and to meet our own high standards of business practice; and/or
To meet our legitimate interests, for example to assess Events and improve our business processes, to communicate with you about Events, and to plan and evaluate our marketing and business development programs.

We obtain your consent to collect and use certain types of Personal Information when we are required to do so by law (for example, in relation to direct marketing activities). If we ask for your consent to process Personal Information, you may withdraw your consent at any time by contacting us using the details at the end of this Events Privacy Policy.

Disclosures & Onward Transfers

We do not sell or otherwise disclose Personal Information that you provide to us or that we collect, except as described here. We may disclose, or have disclosed in the previous 12 months, Personal Information that you provide to us or that we collect about you with:

Subsidiaries and ICE Affiliates: We disclose Personal Information to subsidiaries and the ICE Affiliates for the purposes of providing the services you have requested and to fulfill our contractual obligations to you, and to fulfill legal and regulatory obligations. We may also disclose Personal Information to subsidiaries and affiliates for their marketing use and so that they may develop and improve products and services, and, subject to applicable law, send you promotional and informational communications.
Third Party Service Providers: To enable us to more efficiently provide the products and services that you have requested from us, we may disclose your Personal Information to selected entities that act on our behalf as our agents, suppliers, or providers, or these entities may collect your Personal Information on our behalf. This may include payment service providers, analytics providers, hosting providers and advisers.
Event Sponsors and Exhibitors: During the registration process, we may disclose your Personal Information to Event sponsors and exhibitors to allow them to contact you about their products and services, if permitted by applicable law.
Other Third Parties: To the extent you do not opt out of the disclosure of your contact information within an event registration, your contact information may be shared with third parties to allow them to contact you about their products and services, if permitted by applicable law. This information also may include your employer and job title.
Other Event Attendees: To the extent that you do not opt-out of the disclosure of your contact information in the attendee list, your contact information may be disclosed to other attendees.
Your Employer: We may disclose your Personal Information to your employer upon request to validate attendance.
Certifying Bodies: We may disclose your Personal Information to certifying bodies if the attendance contributes to continuing education credits (or their equivalent).
Legal Compliance and Protection of Our Rights: We may disclose your Personal Information to law enforcement, governmental authorities and third parties where we believe it is necessary to comply with a court order, subpoena, or regulatory request.
Transfer of Business Assets: As we continue to develop our business, we might acquire or buy other businesses or assets. In such transactions, we may disclose your Personal Information to the acquired entity.
Disclosures Made with Consent: We may disclose your Personal Information to other third parties with your consent.
Additional Disclosures: We may disclose your Personal Information to our attorneys, banks, auditors, and other professional service providers and advisors in connection with the purposes described above.

If you choose to schedule appointments with other attendees, exhibitors, or sponsors, then your Personal Information (including your name, company, email address, and any comments if provided) will be made available to these third parties as a result of the booking process.

International Transfers of Personal Information

We may transfer, process, and store your Personal Information outside of your home country, including in the United States and Canada, or other jurisdictions with a comparable protection standard. For the avoidance of doubt, if you are resident in the European Economic Area (“EEA”) or the United Kingdom (“UK”) this may include the transfer of your Personal Information from within the EEA or UK to a country outside of the EEA or UK. We have put in place appropriate safeguards for international transfers, such as Standard Contractual Clauses approved by the European Commission and the UK Addendum to the Standard Contractual Clauses, as well as technical safeguards in accordance with legal requirements and the recommendations of the European Data Protection Board. Security & Retention

We have put in place certain safeguards to help prevent unauthorized access and maintain data security with respect to your Personal Information. Despite these protections, however, we cannot guarantee that your data will be 100% secure. You should take measures to protect your Personal Information. In case there is unauthorized access to or use of your Personal Information, we may notify you of such access or use, including by electronic means if permitted by law.

We retain your Personal Information for as long as we have a relationship with you and for a period after the relationship has ended and as required by law. When determining how long to keep your Personal Information after our relationship with you has ended, we take into account how long we need to retain the information to fulfil the purposes described above and to comply with our legal obligations, including regulatory obligations. We may also retain Personal Information to investigate or defend against potential legal claims in accordance with the limitation periods of countries where legal action may be brought. At the end of this period, we will delete, anonymize, or deidentify your Personal Information.

Your Rights and Choices

Subject to local law, you may have certain rights regarding your Personal Information. These may include, depending on the circumstances, the following rights to:

Access your Personal Information;
Rectify or correct the Personal Information we hold about you;
Erase/Delete your Personal Information;
Restrict our use of your Personal Information;
Object to our processing of your Personal Information;
Receive your Personal Information in a usable electronic format and transmit it to a third party (also known as the right of data portability);
Receive additional information regarding the sources from which we collect information, the purposes for which we collect and disclose Personal Information, the information of yours we hold, and the categories of parties to whom we disclose your information;
Limit the processing of your Sensitive Personal Information;
Opt-out of the “sale” or “sharing” of Personal Information (as those terms are defined by applicable law);
Lodge a complaint with your local data protection authority; and
Withdraw any consent you have given to uses of your Personal Information.

We may disclose the Personal Information described in this Events Privacy Policy with subsidiaries, affiliates, and business partners for their marketing use and so that they may develop and improve products and services, and subject to applicable law send you promotional and informational communications.

If you would like to discuss or exercise the rights you may have, you may contact us as described below in the “How to Contact Us” section or use the Privacy Web Form to opt-out from sales or sharing of Personal Information.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf, and we may require you to verify your own identity directly with us.

Depending on where you are located, you may also have the right to appeal a decision that we make relating to your request to exercise a right related to your Personal Information.

You may exercise your rights without fear of discrimination or of being denied goods or services. We may, however, provide a different level of service or charge a different rate as permitted by applicable law.

In addition, you may have the option to opt-out of the disclosure of your contact information to other Event attendees, such as through an attendee list, by following the instructions provided in the mobile application used for a particular Event.

Children

Events are not intended for minors (persons under the age of 18 and, in those Canadian provinces where the age of majority is 19, persons under the age of 19). We do not knowingly sell the Personal Information of minors under 16. If you are a minor, do not attend Events. If parents or guardians believe their minor children have provided their Personal Information to us, please contact us using the information provided in the “How to Contact Us” section of this Events Privacy Policy so that we may delete the information.

Updates to Our Notice

This Events Privacy Policy is current as of the effective date set forth above. We reserve the right to change this Events Privacy Policy from time to time. Changes and modifications to this Events Privacy Policy will be effective immediately upon posting of the changes and modifications on the Digital Services, except where prohibited by law. You should therefore periodically visit this page to review the current Events Privacy Policy. If we change this Events Privacy Policy, we will notify you of the changes by updating the effective date at the top of this Events Privacy Policy and, if required by applicable laws, by other means, such as email or notice using the contact information you provide to us. If at any time you choose not to accept the terms of this Events Privacy Policy, you should not attend Events.
